President Alvi Approves New Anti-Rape Ordinance For Speedy Conviction

Rape is a crime that is beyond the pale amongst all crimes that take place in Pakistan. It is the most mutilated form of harassment that takes place against women and children. President Alvi Approves New Anti-Rape Ordinance For Speedy Conviction.

Rape shatters the soul of women and children of all ages but it also prickles them socially, physically, and mentally. President Dr. Arif Alvi went by the rules of prissy and holistic Anti-Rape (Investigation and Trial) Ordinance, 2020, dignifying the definition of rape and to help expedite cases of sexual abuse against women and children.

“The special courts will be set up across the country to expedite trials and cases of rape at the earliest, and the courts are to deal with rape cases within four months. Moreover, the ordinance broadens the definition of the rape victims including men and transgender persons as rape victims as well.”

Changes made in the ordinance

“The changes include the incipience of special courts, anti-rape crisis cell, protection of victims and witnesses, and embargo of the intrusive two-finger test. The ordinance has also inducted new laws to award exemplary punishment to rapists, including chemical castration and hanging, but not in public.”

A sex offenders’ archive will also be made part of the ordinance inveterate at the national level with the help of the National Database & Registration Authority (NADRA). The ordinance also bars the identification of rape victims and makes it a queasy and punishable offense.

According to a statement issued by the law ministry,

A meeting of the federal cabinet committee in November had approved two ordinances to introduce punitive punishments for sex offenders including chemical castration and setting up special courts for rape cases.

“The Anti-Rape (Investigation and Trial) Ordinance, 2020 and the Criminal Law (Amendment) Ordinance, 2020 introduced the concept of chemical castration mainly as a “form of rehabilitation. The two-state of art pieces of legislation are in line with the Constitutional guarantees of Pakistan, as also the International treaties”.

The peninsular features of the Anti-Rape Ordinance

It includes the concoction of anti-rape cells headed by a commissioner or deputy commissioner to stick up for registration of an FIR, medical examination, and forensic analysis. The ordinance also bars the cross-examination of a rape survivor by the suspects. Only the judge and accused’s lawyers will be able to cross-examine the survivor.

The establishment of the anti-rape ordinance is indeed appreciable but the thing that matters is its enforcement.
